Appdome Privacy Policy

Appdome Inc. and its affiliates (together, “Appdome,”“us,”“our” or “we”) are dedicated to protecting our users’ (“Users,” “you” and “your”) privacy.

This Privacy Policy provides information about our practices with respect to information, including personally identifiable information (“Personal Information”), that is collected by us in connection with our automated mobile integration platform located at fusion.appdome.com (the “Platform”) and our website located at www.appdome.com (the “Site” and together with its related sites, the “Sites”) from you, a user of our Service (“you” and “your”) and end users of your mobile applications (“your End Users”). The Sites, the Platform and the set of software code added by our technology to mobile applications on the Platform (each, a “Fusion Adapter”) are together referred to herein as the “Service.”

By using our Service or any part of our Service you are consenting to the processing of information about you and your End Users, including Personal Information. As used herein, “process” or “processing” means using or accessing information in any way, including, but not limited to, collecting, storing, deleting, combining, verifying, categorizing, synthesizing, analyzing, publishing or disclosing such information in connection with our Service as described below.

Personal Information” means data that allows someone to personally identify you or your End Users, including, for example, your name, address, telephone number, e-mail address, profile photo, and Service Use Data, as well as any other non-public information that is associated with or linked to that Personal Information.

Anonymous Information” means information pertaining to you or your End Users that is not associated with or linked to Personal Information.  Anonymous Information does not, by itself, permit the identification of individual persons.  We may also collect or develop aggregated information, which may include Personal Information or Anonymous Information, provided that such information does not personally identify you or your End Users.  Such aggregated information is referred to herein as “Aggregated Information.”

Please note that the scope of this Privacy Policy is limited to information collected or received by Appdome through your and your End Users’ use of the Service. Appdome is not responsible for the actions of third parties, the functioning of their services, the use of information you or your End Users provide to such third parties, or any products or services they may offer. Any link to third-party sites does not constitute our sponsorship of, or affiliation with, any such third-party service or site.

1. Information We Collect

We need certain Personal Information in order to provide you with access to and use of the Service. If you registered with our Sites, or created an account on our Platform, you may be asked to indicate your consent for us to process your Personal Information. You maintain the right to withdraw such consent at any time. If you do not agree to our use of your Personal Information in line with this policy, please do not use our Service.

If you are an individual from the European Economic Area (EEA), our legal basis for collecting and using Personal Information will depend on the Personal Information concerned and the specific context in which we collect it. However, we will normally collect Personal Information from you only where: (a) we have your consent to do so, (b) where we need the Personal Information to perform a contract with you (e.g. to deliver the Services you have requested), or (c) where the processing is in our or a third party’s legitimate interests (and not overridden by your data protection interests or fundamental rights and freedoms). In some cases, we may also have a legal obligation to collect Personal Information from you, or may otherwise need the Personal Information to protect your vital interests or those of another person.

When you and your End Users interact with us through the Service, we collect and use Personal Information and other information from you and your End Users, as further described below:

a. Registration and Account Information

Parts of our Service require you to open an account with us. To access these parts of our Service, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form, including your name and email address. You also will choose a password and may provide a user name. As part of your account profile, other information we may collect includes physical address, your title, organization, and phone number, along with your account type selection and other profile data you provide to us. We use such information to manage and support your Appdome account and to provide you with access to our Service. 

b. Registration via Social Sign-In Services

Registration on the Service might be available by using a Facebook, Google+, LinkedIn, OpenID Connect or other third-party platform to perform sign up (a “Social Sign-In Service”). By accessing the Service through a Social Sign-In Service you are authorizing us to collect, store, and use in accordance with this Privacy Policy any and all information that you allow the Social Sign-In Service to provide to us in connection with the Service based on your Social Sign-In Service settings. The authorization and consent you provide to us takes place when you elect to register and connect to our Service via the Social Sign-In Service.

c. Credit Card and Billing Information

When you register, or when you subscribe to our Service, you may be prompted to provide credit card information to complete certain transactions you request on our Service. During that process, we may collect the credit card information necessary to complete the requested transaction. This information may be shared with other parties who process your purchases. If and when you submit credit card information to us, our payment provider or we will encrypt your credit card information using industry standard technology to protect that information.

d. Information You Provide Directly to Us

At any time during your use of our Service you may provide us feedback, contact us for information about our Service, enter a support request, request pricing, request a demonstration of our Service, or otherwise contact us via our Service or via e-mail. During these interactions, we will collect your name, e-mail address and other information submitted to us, including any content included in your communications with us. During these and other interactions, we may also collect other types of Personal Information that you provide to us voluntarily, such as your employer, company, location, operating system and version, mobile apps, integration projects, network environment and other information necessary to respond to the feedback, inquiry or request you make of us. If you provide feedback or other information via our Service, including information in discussions, comments, forms and correspondence through our Sites, and including any direct correspondence you send to us, we may use such information in accordance with this Privacy Policy.

e. Participation with Others on our Service

As an openly accessible, mobile integration platform, Appdome expects to enable you to share and collaborate with other Users. During this collaboration, we encourage you to refrain from disclosing Personal Information about yourself to other Users. You acknowledge that we cannot control what you or any other User discloses on our Service. If you share Personal Information about yourself, such as information beyond what we make generally available on our Service, we cannot guarantee the privacy or security of any such information. You agree that the information you obtain or share on the Service is solely and strictly for use in connection with the Service (and not for any other purpose).

f. Service Use Data

You choose how and when to use our Service. Each time you use our Service, our servers automatically receive and store information about you and the actions you take on our Service, including the mobile applications you upload to our Service, configuration choices you make, services you test and use, Teams you establish, integration projects you start and complete, mobile applications you sign, signing credentials you save and store on our Service, Fusion sets (integration templates) you make, downloads you make from our Service, the mobile services, including mobile SDKs (or implementations thereof), you combine with mobile apps associated with your account, and the combined app binaries you deploy via our Service (including the binaries, images, marks, and other information contained therein, “Fused Mobile Apps”). Any information we process regarding your selections and activities on the Service is referred to herein as “Service Use Data”. Service Use Data is specific to you and your account. Service Use Data includes the use, history of use, viewing history, search history, and support history associated with your account on our Service.

g. Log Data

In addition to Service Use Data, when you interact with, or deploy integrated mobile apps from, our Service, our servers automatically receive and store certain information about you and Anonymous Information about your End Users,including interactions with demonstrations, offerings, links, and content on our Service, device IDs (including mobile device IDs of your End Users),mobile application IDs,connection information, error events, network events, cookie data including statistics on page views, traffic to and from the sites associated with the Service, IP address and standard web log information (together, “Log Data”). This Log Data is collected passively and may include information such as your Internet Protocol (“IP”) address, browser type or the domain from which you found the Service, the Site pages you visit, the search terms you use, and any advertisements on which you click, all within the context of our Service. You agree that we may collect and process Log Data.  We may use Log Data to provide you with the Service (for example, to provide push notifications on your mobile device or on the mobile devices of your End Users)and pool it with other information to monitor the use of the Service, and for the technical administration of the Service. We do not associate your IP address with any Personal Information to identify you personally, except in cases where we are asked to comply with a subpoena or other legal demand or where we suspect that there has been a violation of our policies, our Terms of Use and/or applicable law.

h. Cookies

We use cookies and other technologies stored on your device to collect Site usage data and to improve the Sites and Service. As is true of most applications, we gather some information automatically and store it in log files associated with our Service. A “cookie”is a small piece of information that a website assigns to your device while you are viewing a website. While we use cookies and similar devices to track your use of the Service (such as the number of downloads and how many users we receive daily), and web servers automatically log the IP address of your computer, we do not use this information to identify you personally.  In general, our cookies only collect information with respect to your visits to and actions on our Service. Social media sharing or “like” buttons available on the Service that allow you to engage with our content on or through a social networking website such as Facebook, Twitter, LinkedIn or Google+ also generate cookies that provide us information about you.

We offer certain features that are available only through the use of cookies. For example, we use cookies to help identify you and maintain your signed-in status and allow you to navigate between pages efficiently, enable automatic activation of certain features, remember your preferences and make the interaction between you and our services quicker and easier. Cookies allow our Service to remember choices you make when you use our Service, such as remembering your login details, remembering your project status, and remembering the changes you make to other parts of our Service that you can customize. Without these cookies, you would be required to re-enter your choices or re-do your work every time you visit and use our Service and we only use these cookies to provide you with the services you requested or integrated using our Service.

You may remove our cookies by following the instructions of your device; however, if you choose to disable cookies, some features of our Service may not operate properly and your online experience may be limited. You agree that we may use cookies and similar devices, and process the data collected by them.

i. Pixel Tags

In addition, we use “Pixel Tags”(also referred to as clear Gifs, Web beacons, or Web bugs).  Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of Web users.  In contrast to cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in Web pages.  Pixel Tags also allow us to send e-mail messages in a format Users can read, and they tell us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our Users.  We may use this information to improve the design and accessibility of our Sites or reduce or eliminate unwanted messages to you.  We do not tie the information gathered by Pixel Tags to your Personal Information.

j. Flash LSOs

When we post videos, third parties may use local shared objects, known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features.  Flash Cookies are different from browser cookies with respect to the amount and type of data and how the data is stored.  Cookie management tools provided by your browser will not remove Flash Cookies.  To learn how to manage privacy and storage settings for Flash Cookies, click here: http://www.macromedia.com/support/documentation/en/flashplayer/help/settings_manager07.html.

k. Supporting Services

We use Google Analytics and other third-party analytics services such as Mixpanel to monitor, operate and improve our Sites and Platform, to gather broad demographic information and to better communicate with you via our Sites and Platform. In addition to Google Analytics and Mixpanel, we use marketing automation, sales and support tools and services such as HubSpot, Intercom, and Zendesk (together with Google and such other third-party analytics services, “Supporting Services”), to collect information about use of the Service, communicate directly with you and provide productive use of the Service to you. We use Supporting Services to compile reports on Service activity, respond to support and other requests, and generally provide the Service to you. These Supporting Services may process information about you, use their own cookies or use similar technologies to record when you visit our Sites, collect information such as how often you visit our Sites, what pages you visit, when you do so, as well as what interactions you had with our Service. If you are from certain territories (such as the EEA), the Supporting Services are data processors, who process data about you and the Service on behalf of us. The information gathered by Supporting Services (the “Support Information”) is provided to us in the ordinary course of providing our Service to you. The Supporting Services may transfer information to third parties where required to do so by law, or when such third parties process Support Information on their behalf.  Each Supporting Service’s ability to use and share Support Information collected by each of them is governed by the Supporting Service’s terms of use and privacy policy.  We may also partner with ad companies to support our marketing efforts, including serving you ads better tailored to your likely interests.  If you don’t want to take advantage of these services, you may be able to opt-out by visiting http://aboutads.info/ or http://networkadvertising.org/choices, or if you are located in the EU, http://youronlinechoices.eu/or http://www.youronlinechoices.com/uk/your-ad-choices.

l. Mobile End User Information

The Service provides certain limited information to you and to us about your End Users’ use of your Fused Mobile Apps. We receive a limited amount of this information via an “agent” (the “Agent”) in our FusionAdapter that is included in the Fused Mobile Apps you create on our Service. The Agent may collect information that includes device installations of Fused Mobile Apps, device identifiers and mobile application identifiers, mobile application activations, security and other service event data generated by your End Users based on services you integrate into Mobile Apps on our Service. We use the data we receive to create reports for you, show you events within your Fused Mobile Apps and audit licenses of our Services. We may provide you with Aggregated and Anonymous Information that includes your End User data.

m. Aggregated and Anonymous Information

We may also collect Anonymous Information about your online activities on our Sites and use this information in making our Service better and more accessible. We may collect, compile, store, publish, promote, report, sell or otherwise disclose or use any and all Aggregated Information and Anonymous Information. When we share such information with third parties, it is not traceable to any particular user or End User and will not be used to contact you or any End User.

n. Authentication Requests

We may ask you to authenticate yourself if we believe your account may have been compromised or your activities violate our policies or Terms of Use.

2. Use of Personal Information

We may collect, use and process any information we receive, including your Personal Information, to provide you with the Service, to respond to requests that you make, to aid us in serving you better, or for our other legitimate business needs such as communicating with you.

Without limiting the foregoing, we may collect, use and process your Personal Information to:

  • Provide the Service to you, including creating and maintaining an account for you, granting you access to the Service, and allowing you to use the Service.
  • Communicate with you, including sending you a welcome e-mail to verify ownership of the e-mail address provided when you create your account, confirmations, invoices, technical notices, updates, security alerts, support and administrative messages.
  • Make it easier for you to use our Service, including understanding your preferences, selections and use to enhance your experience with our Service.
  • Measure and improve our Service, including understanding how to improve our content, UI and our user experience.
  • Market our Service and our partners’ services to you, including Service updates, new offerings, Service extensions, promotions, rewards, upcoming events, products and services of our partners that we believe may be of interest to you and other news about products and services.  If you decide at any time that you no longer wish to receive such marketing information or communications from us, please follow the unsubscribe instructions provided in any of the communications.
  • Support you and your End Users, including troubleshooting any issues that may arise in connection with your use of the Service, and responding to and resolving customer support requests.
  • Bill you for use of our Service, including auditing your use and information relevant to the features of the Service you and your End Users use, sending billing requests, and other matters related the payment of amounts owed by you to us.
  • Resolve disputes, including disputes between you and any partner service offered via our Service, billing disputes and other problems that may arise on our Service.
  • Prevent, detect, and investigate potentially prohibited or illegal activities, including enforcing our Terms of Use.
  • Compare information for accuracy, including verifying information with third parties.
  • Respond to your inquiries related to employment opportunities, and other requests, make telephone calls to you, from time to time, as part of secondary fraud protection or to solicit your feedback, send newsletter surveys, offers, and other promotional materials related to our Service.

In an ongoing effort to better understand and serve you and your End Users, we may conduct research on user demographics, interests, activities and behavior based on the Personal Information and other information provided to us. This research is important to the development of new features, algorithms, and advancement of our Service.  Such research will be compiled and analyzed on an aggregate basis, and we may share this Aggregated Information with our employees, affiliates, agents, board members, advisors and business partners. We may also disclose Aggregated Information in order to describe our Service to current and prospective business partners, investors and to other third parties for other lawful purposes. We may combine information we collect with other information we receive from other companies and use it to improve and personalize our Service, including providing additional content, features and advertising. We do not use your Personal Information for the purposes of automated decision-making.  However, we may do so in order to fulfill obligations imposed by law, in which case we will inform you of any such processing and provide you with an opportunity to object.

3. Protection of Personal Information

We take measures, consistent with industry standards to protect your Personal Information and process Personal Information in accordance with applicable data protection and privacy laws. Your account is specific to you. We assign a unique ID to every account and you create a password that protects your account. If you share your log-in credentials or your Personal Information with others, you are responsible for all actions taken in the name of your account. If you lose control of your account, you may lose control over your Personal Information. You may also be subject to legally binding actions taken on your behalf. Therefore, if your account has been compromised for any reason, you should immediately notify Appdome and change your password.

4. Disclosure of Personal Information

We may disclose Personal Information as described below and as described elsewhere in this Privacy Policy to:

a. Payment Platform Providers

We may share your Personal Information with payment providers, including credit card providers, PayPal or other payment platforms to provide payment processing, transaction settlement and similar services, including associated registration, transaction processing and customer support.

b. Service Providers

We may share your Personal Information with service providers such as analytics services including those parties identified in paragraph 1(k), each of whom are under contract to provide us services necessary to operate our business and the Service, conduct quality assurance testing and to provide technical support for the Service. The nature and scope of work provided by these service providers includes but is not limited to analytics providers, support platform providers, marketing automation providers, fraud investigation providers, bill collection providers, affiliate and rewards program providers.

c. Affiliates and Acquisitions

We may share some or all of your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy.  We may share some or all of your Personal Information in connection with or during negotiations of any merger, financing, acquisition or dissolution transaction or any proceeding involving the sale, transfer or divestiture of all or a part of our business.  If another company acquires our company, business or our assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.  In the event of an insolvency, bankruptcy or receivership, your Personal Information may also be transferred as a business asset.

d. MSV and ISV Partners

The Service allows you to integrate mobile apps, including those provided via our independent software vendor (“ISV”) partner network, with other services, including those provided via our mobile solution vendor (“MSV”) partner network. MSV services integrated with mobile apps, including ISV mobile apps, via our Service remain subject to the terms and conditions of use, including the privacy policy, associated with that third-party service or app. If you provide our partners with Personal Information about you or your End Users, such disclosure is subject to the policies and terms of use of the respective company providing you its service or app. We may receive information from these partners and may add such information to the information already collected from you. At some point, either in the context of providing or supporting our Service, we may share your Personal Information and Anonymous or Aggregated Information with certain partners with which we have formed strategic alliances to better serve or support you.

e. Third Party – Data Processors

If you are from certain territories (such as the EEA), the parties referenced in this Section 4 are data processors, who process data about you and the Service on behalf of us. Third-parties we contract or partner with to provide the Service to you each make their own commitments to process Personal Information in accordance with applicable data protection and privacy laws as published in the respective parties’ terms of use and privacy policies.

f. Required Disclosures

Regardless of any choices you make regarding your Personal Information, we may disclose Personal Information if we believe in good faith that such disclosure is necessary (i) in connection with any legal investigation; (ii) to comply with relevant laws or to respond to subpoenas or warrants served on us; (iii) to protect or defend the rights,property or safety of Appdome or Users of the Service; (iv) to investigate, report or assist in preventing any violation or potential violation of the law, this Privacy Policy or our Terms of Use; and/or (v) to respond to claims that your activities violate the rights of others.

5. Notice to California Residents

NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS (AS PROVIDED BY CALIFORNIA CIVIL CODE SECTION 1798.83)

A CALIFORNIA RESIDENT WHO HAS PROVIDED PERSONAL INFORMATION TO A BUSINESS WITH WHOM HE/SHE HAS ESTABLISHED A BUSINESS RELATIONSHIP FOR PERSONAL, FAMILY OR HOUSEHOLD PURPOSES (A “CALIFORNIA CUSTOMER”) MAY REQUEST INFORMATION ABOUT WHETHER THE BUSINESS HAS DISCLOSED PERSONAL INFORMATION TO ANY THIRD PARTIES FOR THE THIRD PARTIES’ DIRECT MARKETING PURPOSES.  IN GENERAL, IF THE BUSINESS HAS MADE SUCH A DISCLOSURE OF PERSONAL INFORMATION, UPON RECEIPT OF A REQUEST BY A CALIFORNIA CUSTOMER, THE BUSINESS IS REQUIRED TO PROVIDE A LIST OF ALL THIRD PARTIES TO WHOM PERSONAL INFORMATION WAS DISCLOSED IN THE PRECEDING CALENDAR YEAR, AS WELL AS A LIST OF THE CATEGORIES OF PERSONAL INFORMATION THAT WERE DISCLOSED.  CALIFORNIA USERS MAY REQUEST FURTHER INFORMATION ABOUT OUR COMPLIANCE WITH THIS LAW BY E-MAILING US AT LEGAL@APPDOME.COM.  PLEASE NOTE THAT WE ARE REQUIRED TO RESPOND TO ONE REQUEST PER CALIFORNIA CUSTOMER EACH YEAR, AND WE ARE NOT REQUIRED TO RESPOND TO REQUESTS MADE BY MEANS OTHER THAN THROUGH THIS E-MAIL ADDRESS.

6. A Note to Users Outside the U.S.

In most cases, your Personal Information is stored on servers located in regional cloud services to comply with local or country-specific laws. If you choose to provide us with Personal Information, you consent to the transfer and storage of that information on servers located in the United States. If you reside outside the U.S., by using the Service, you acknowledge and agree that your Personal Information may be transferred to the U.S., and processed and stored in the U.S.  By using our Service, you understand that your Personal Information may be transferred to our facilities and to those third parties with whom we share it as described in this Privacy Policy.

We may transfer information that we collect about you to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. Your data, including Personal Information that we collect from you, may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. By using our Service, you agree to this transfer, storing or processing. In addition, we rely upon European Commission-approved standard contractual data protection clauses or other appropriate legal mechanisms to safeguard certain such transfer, storage or processing. We will strive to take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this policy. You may contact us anytime to opt-out of the transfer of your Personal Information outside the European Economic Area (EEA). Please note that your use of some of the Service may be de-activated upon opt-out.

7. Use of Service by Children

Appdome does not knowingly collect Personal Information from children under the age of 16. In the event you become aware that an individual under the age of 16 has enrolled, please advise us immediately.

8. Closing Your Account

Upon your request, we will close your account and remove your Personal Information in accordance with paragraph 10(d).

9. Third Parties

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you or your End Users. If you or your End Users disclose your information to others, we are not responsible for what they do with that information. Appdome does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your Personal Information to others.

When you click on a link to any other website or location, you will leave our Site and go to another site, and another entity may collect Personal Information or other information from you.  We have no control over, do not review, and cannot be responsible for, these outside websites or their content.  Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

10. Controlling How We Use and Process Personal Information

a. Newsletters, Surveys, Etc.

When you receive newsletters, surveys, offers, and other promotional materials from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below).  Despite your indicated preferences, we may send you service-related confirmations or communications, including notices of any updates to our Terms of Use or Privacy Policy.

b. Cookies

If you decide at any time that you no longer wish to accept cookies from our Service for any of the purposes described above, you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit.  Consult your browser’s technical information.  If you do not accept cookies, however, you may not be able to use all portions of the Service or all of the functionality of the Service.  If you have questions about how to disable cookies, please let us know at the contact information provided below.

c. De-Linking Social Sign-In Platform

If you decide at any time that you no longer wish to have your Social Sign-In Platform account linked to your Appdome account, then you may de-link the Social Sign-In Platform account in the “preferences” section in your account settings.  You may also manage the sharing of certain Personal Information with us when you connected with us through a Social Sign-In Platform, such as Facebook Connect.  Please refer to the privacy settings of the Social Sign-In Platform to determine how you may adjust our permissions and manage the interactivity between the Service and your Social Sign-In Platform account.

d. Retention and Control.

We retain your Personal Information for as long as your account is in existence and a reasonable period thereafter in case you decide to re-activate your account.  We also retain some of your Personal Information as necessary to process Aggregated Information correctly, comply with our legal obligations, to prevent fraud, to resolve disputes, to collect any fees owed, to enforce our Terms of Use and other agreements, to troubleshoot problems, to assist with any investigations, to support business operations, to continue to develop and improve our Service,and to take other actions otherwise permitted by law. We retain information derived from cookies and other tracking information for a reasonable period of time from the date such information was created. After such time, we will either delete or anonymize your Personal Information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible. Appdome is not responsible for any use by you of any data about your End Users. Your End Users should review your policies to understand your use of their information.  You are prohibited from using the Service (including without limitation the Agent) to independently collect any Personal Information about any of your End Users.

We reserve the right to periodically amend or revise the Privacy Policy; changes will be effective immediately upon the posting of the revised Privacy Policy.
